Agent Liberty considers the privacy of its users to be a serious issue. Please read the following to learn more about our privacy policy.

1.1 This agreement ‘the agreement is between ‘Agent Liberty’, ‘us’, the Seller and the landlord, ‘you’.

1.2 By entering into this agreement you are confirming you have read the terms and conditions, and you agree to them

1.3 You agree for Agent Liberty to market your property on our websites, partner sites and any other form of advertising.

2. Your responsibilities 

2.1 You have the legal right to let or sell the property.

2.2 A representative of Agent Liberty must visit the property before publishing a listing.

Agent Liberty does not take any responsibility for the accuracy of the information or images supplied and cannot be liable.

2.3 We require the listing fee in full and an EPC report before the listing will be published.

2.4 Agent Liberty will not be held liable for any breach of copyright if you supply your own images.

2.5 Only one property may appear per listing.

2.6 You will conduct all viewings for the marketed property, unless you have requested a viewings package from our optional services. All optional extra's will be discussed and offered when our representative visits your property.

2.7 Agent Liberty will notify you (the seller) of any offers we receive in writing (unless otherwise intsructed by yourselves).

2.8 Agent Liberty will not be liable for any computer virus transmitted through the site. It is your responsibility to use suitable antivirus software.

2.9 The seller or landlord agrees to have a current EPC (Energy Performance Certificate) that will be provided on request before the start date of advertising.

2.10All sellers and landlords agree to market at least one image of the property.

3. Agent Liberty Responsibilities 

3.1 We will market your property details within 3-4 working days on our partner sites subject to cleared payments via our merchant system (paypal). A representative of Agent Liberty will visit your premises to verify your property descriptions. You are also required to have an EPC report and be fully legally compliant. Working days are deemed Monday - Friday except for bank holidays and national holidays.

Publication on our partner sites may be subject to alteration.

3.2 We reserve the right to take the site offline for upgrades or essential maintenance. This will be done without prior notice.

3.3 Agent Liberty will not disclose your personal details to any third party without your permission, unless we are requested to do so legally. We will only publish the details that you select as part of your listing. We reserve the right to email you further promotional and marketing offers.

3.4 We shall be entitled to suspend any services without notice or liability where the client has used the service in an unlawful manner or the advert has failed to comply with our terms and conditions.

3.5 Agent Liberty is entitled to suspend/terminate the services in full at any time, by giving all sellers or landlords 24hrs notice.

3.6 Agent Liberty strictly forbids the publishing of personal contact details in any form. Misuse of this nature will lead to the immediate removal of a listing. No refund will be given in this situation.

4. Limitation of Liability

4.1 Agent Liberty will under no circumstances be deemed liable for negligence, breach of contract, loss of data or profit, failure to perform, misrepresentation or otherwise, for a direct or indirect loss or damage suffered by you as a result of use or association with our website.

4.2 All sellers or landlords agree and fully accept Agent Liberty's liability will under no condition or circumstance ever exceed the advertising fee received

4.3 When we collect personal information from you via this website, which we will tell you about the purposes for which we may us it. We will not disclose it to any other third party without your permission unless we are required to do so by law. We issue periodic newsletters to registered customers giving useful tips as well as information about other services we may offer to sellers or landlords. If you do not wish to receive additional information about our services then you can send us an email requesting your details to be removed from our mailing list. We reserve the right to update this policy. We will notify you about significant changes in the way we treat personal information by placing a prominent notice on our web site.

5. Security, Card Payments and Personal Details

5.1 For us to process your order, we need to know your name, contact address, telephone number, email address and credit /debit card details (if appropriate - payment by cheque is also available). In addition, details of the address and description of the property for sale or let if differing from the contact address is needed.

5.2 We never pass any of your information to third parties without first gaining your explicit consent. We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. If you find any inaccuracies we will delete or correct it promptly.

5.3. When you enter credit card information on this web site our secure systems ensure that all details are fully encrypted at your browser before they are sent. Sensitive credit card details are handled directly and stored on the secure servers of our payment processors PAYPAL UK (Merchant Services). Your card details are only held and processed by this organisation.

For your protection and security, Agent Liberty DOES NOT receive the card number or details (other than an automated confirmation of any order placed).

6. Cancellations & Refund Policy

6.1. Customers have the right to cancel an order within 2 working days of placing an order. By agreeing to these terms and conditions and making a payment for our services, you agree to waiver the 7 day cooling off period of a standard contract.

6.2. Customers cancelling their orders will have their payment refunded in full - minus debit/credit card charges incurred by Agent Liberty and other non-refundable charges requested by third parties.

Your property will not be published until the two day period has expired. The two-day period allowed for a refund is not intended to allow sellers or landlords to 'trial' the Agent Liberty’s service.

This does not affect your statutory rights.
